1. About these Terms

These Terms of Use ("Terms") apply to your use of biantech.org and its pages ("the Site"), run by BIAN Tech ("BIAN", "we", "us", "our"), including the Site's newsletter. By using the Site you accept these Terms. If you do not accept them, please do not use the Site.

Our apps have their own terms, which apply to them instead of these Terms:

If one of our apps has no terms of its own, such as My Trackr, these Terms apply to it together with its privacy policy, with "the Site" read as including that app.

2. Using the Site

You may browse the Site and share links to it. You agree not to:

  • use the Site in a way that breaks the law or infringes anyone's rights;
  • try to gain unauthorised access to the Site, its hosting or related systems, or test their vulnerability without our permission;
  • disrupt the Site, overload it, or spread malware through it;
  • copy the Site's content in bulk or present it as your own.

3. Content and trademarks

The Site's text, design, graphics, images, videos and code, and the names and logos BIAN, BIAN Tech, Smart Calendar and Bianex, belong to BIAN or its licensors and are protected by law. Fonts on the Site are used under the SIL Open Font License. These Terms give you no right to use our names or logos, except to refer to our products accurately.

4. Information on the Site

We try to keep the Site accurate and up to date, but its content is general information about our products. Features, availability and requirements can change, and the app listing on the relevant store, and each app's own terms, take precedence. Screens and films on the Site show the apps as they were when filmed and may differ from what you see.

5. Newsletter

If you subscribe to our newsletter, we will send you occasional news about BIAN and our products, and nothing else. You can unsubscribe at any time by replying to any newsletter or writing to us. The Website Privacy Notice explains how we handle your email address.

7. No warranties

To the fullest extent the law allows, the Site is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will always be available, error-free or free of harmful components.

8. Limitation of liability

To the fullest extent the law allows, BIAN and its owners, developers, employees and agents are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, revenue or goodwill, arising out of or in connection with the Site or these Terms. To the fullest extent the law allows, our total liability for all claims relating to the Site is limited to USD 10.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, such as for death or personal injury caused by negligence or for fraud, or your rights as a consumer that cannot be waived.

9. Indemnity

To the extent the law allows, you agree to indemnify BIAN against claims, losses and costs (including reasonable legal fees) arising from your misuse of the Site or your breach of these Terms.

10. Changes

We may change the Site, or these Terms, at any time. We will publish the new Terms here with a new effective date. If you use the Site after a change, the new Terms apply.

11. Governing law and disputes

These Terms are governed by the laws of the country where BIAN Tech is established, without regard to conflict-of-laws rules, except that mandatory consumer-protection laws of the country where you live still apply to you. Before starting any formal dispute, please contact us and give us 30 days to try to resolve it in good faith.

12. General

If a provision of these Terms is found unenforceable, it applies to the extent it can and the rest remains in force. If we do not enforce a provision, we have not waived it. These Terms, together with the Website Privacy Notice, are the whole agreement between you and BIAN about the Site.
