Beta Release Notice

You may be using a beta (pre-release) version of Bianex Browser made available for testing and feedback ahead of the public release. As a beta build:

Aside from the points above, the data practices described in this Privacy Policy apply to the beta version.

1. Introduction

Welcome to Bianex Browser ("the App", "the Software", "our App", "we", "us", or "our"). This Privacy Policy explains how BIAN ("the Company", "the Developer", "we", "us") handles information when you use the Bianex Browser application on Android and other supported platforms.

PLEASE READ THIS PRIVACY POLICY CAREFULLY. By downloading, installing, accessing, or using Bianex Browser, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy and our Terms of Service. If you do not agree with any part of this Privacy Policy, you must not access or use the App and should uninstall it.

Our Core Privacy Principle: Bianex Browser is built to be privacy-respecting. We do not operate user accounts, we do not run advertising or analytics SDKs, we do not profile you, and we do not sell or rent your information. Your browsing data — history, bookmarks, passwords, tabs and settings — is stored only on your device. We do not maintain a copy of it.

At the same time, a web browser is by nature a tool that connects to the internet. The App makes a small number of network connections needed to load web pages and to power core features. These are described transparently in Section 5. We are committed to telling you exactly what those connections are rather than making an absolute claim that "nothing ever leaves your device."

2. Acceptance of Terms; Eligibility

By using Bianex Browser, you expressly acknowledge and agree that:

IMPORTANT: Your continued use of the App constitutes ongoing acceptance of this Privacy Policy and any future modifications. If you do not agree to these terms, discontinue use immediately and uninstall the App.

3. Information We Do NOT Collect

We do not operate servers that receive, store, or process your personal browsing activity. In particular, we do not collect, transmit to ourselves, or retain:

4. Data Stored Locally on Your Device

The following is created and stored only on your device. We have no access to it. You acknowledge that YOU are solely responsible for this locally stored data and for the security of your device:

User Responsibility: All locally stored data is under YOUR control and YOUR responsibility. To the maximum extent permitted by law, BIAN is not responsible for this data, including any loss, corruption, or unauthorized access resulting from device compromise, malware, loss or theft of your device, beta updates, maintenance resets, or your own actions.

5. Network Connections the App Makes

For transparency, this section lists every category of network connection the App initiates beyond the websites you choose to visit. Because the internet works by exchanging messages between devices and servers, any such connection necessarily reveals your device's IP address and basic connection metadata to the destination server (this is true of all web browsers and internet apps). Except where stated, the App sends only what is technically required and does not attach any identity or account to these requests.

5.1 Websites You Visit

When you browse, the App connects directly to the websites and services you request. Those websites may collect information from you under their own privacy policies, over which we have no control.

5.2 Filter and Configuration Updates (BIAN)

To keep ad/tracker blocking effective and to deliver important safety notices, the App periodically downloads, from infrastructure operated by or for BIAN (e.g., bianex.biantech.org):

These are ordinary file downloads. They do not contain your browsing data. Like any web server, the hosting provider may record standard request logs (including IP address) for security and operational purposes. We do not use these logs to build profiles of users.

5.3 Community Filter Lists (Third Parties)

The ad/tracker blocker also downloads publicly available filter lists from independent providers (for example, AdGuard, EasyList, and Peter Lowe's list). Retrieving these lists exposes your IP address to those providers under their own policies. The App downloads only the lists themselves and sends no browsing data.

5.4 Site Icons (Favicons)

To display recognizable icons on the home screen and "frequently visited" tiles, the App may request icons from a public favicon service (currently Google's favicon service). This request includes the domain name of the site whose icon is being fetched. If you prefer not to make these requests, avoid adding such sites to your shortcuts; the App falls back to a generated letter icon when an icon cannot be fetched.

5.5 Page Translation (Optional, User-Initiated)

If you choose to translate a page, the App uses Google Translate. To perform the translation, page text and the page address are sent to Google under Google's privacy policy. This feature is optional and only runs when you explicitly request a translation.

5.6 Media Background Play and Artwork (Optional)

If you enable background audio/video playback, the App may fetch media artwork referenced by the page you are playing so it can show it in the playback notification. This contacts the image host specified by that page.

5.7 On-Device AI Summaries, Safe Browsing, and Crash Logs

You can reduce or avoid most of the optional connections above (translation, enhanced safe browsing, background-play artwork, adding favicon-fetching shortcuts) by not using those features. Core ad-blocking filter updates and the safety/maintenance configuration are part of the App's normal operation.

6. Remote Configuration, Maintenance Mode & Required Updates

The App checks the signed configuration file described in Section 5.2 to determine whether it should display a maintenance notice or require an update. You acknowledge and agree that:

The App requests only the Android permissions listed below. We do not request access to your camera, microphone, location, contacts, photos, or device storage as app-level permissions. (Some websites may ask for such access while you browse; any such prompt comes from the website and the system, and is governed by your per-site choices and Android's own controls.)

INTERNET Load web pages and download filter/configuration updates.
ACCESS_NETWORK_STATE Detect connectivity to avoid failed requests and unnecessary retries.
POST_NOTIFICATIONS Show download progress and media playback controls. You may deny or revoke this.
FOREGROUND_SERVICE (and MEDIA_PLAYBACK / DATA_SYNC types) Continue media playback and downloads reliably while the App is in the background. Runs locally; transmits no data on its own.
WAKE_LOCK Prevent the device from sleeping mid-download or during background media playback.

Permission Control: You may revoke permissions at any time in your device settings. To the maximum extent permitted by law, BIAN is not responsible for reduced functionality resulting from denied or revoked permissions. The exact set of permissions is also shown on the App's store listing and in your device settings, which prevail in case of any discrepancy.

8. Data Security

We apply reasonable, industry-aware safeguards to data the App stores on your device, including encryption of saved passwords via the Android Keystore and use of secure storage for sensitive values. HTTPS is preferred and certificate validation is applied to help protect connections.

Security Disclaimer: No method of electronic storage or transmission is 100% secure. The ultimate security of data on your device depends on YOUR device security (screen lock, system encryption, OS updates, malware protection) and on the websites you choose to visit. To the maximum extent permitted by law, BIAN is NOT responsible for security incidents resulting from compromised or rooted devices, malware, phishing, insecure networks, third-party websites, or user negligence.

9. Your Rights and Choices

Because the App does not collect your personal data on our servers and has no account system, you retain direct control of your information on your device:

9.1 GDPR (EEA/UK) and 9.2 CCPA/CPRA (California)

We do not collect, "sell," or "share" (as those terms are defined under the GDPR, UK GDPR, or the CCPA/CPRA) your personal information for our own purposes, and we do not maintain it on our servers. Rights of access, deletion, correction, and portability are satisfied directly because the data lives on your device under your control. Where any connection in Section 5 routes information to a third party (e.g., Google for translation or favicons), that processing is governed by that third party's policy.

10. Children's Privacy

The App is a general-purpose web browser and is not directed to children under 13 (or the applicable minimum age in your jurisdiction). We do not knowingly collect personal information from children, and because we do not collect personal information at all, none is collected from children through the App. The App does not include parental-control features. Parents and guardians are solely responsible for supervising minors' internet use, and BIAN is not responsible for content a minor may access via the internet using the App.

11. Third-Party Websites and Services

Content, websites, and services accessed through the App are operated by third parties under their own terms and privacy policies.

To the maximum extent permitted by law, BIAN is NOT responsible for the availability, content, accuracy, legality, security, or privacy practices of any third-party website or service, including those referenced in Section 5 (such as filter-list providers, favicon and translation services, and reputation services). Your dealings with third parties are solely between you and them.

The App's privacy features (ad/tracker blocking, cookie-popup handling, anonymous browsing, etc.) are provided as a convenience and reduce — but cannot guarantee elimination of — tracking or data collection by third parties. AI-generated summaries may be inaccurate and are provided for convenience only.

12. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.

Without limiting the foregoing, BIAN does not warrant that the App will meet your requirements; be uninterrupted, timely, secure, or error-free; produce accurate or reliable results; be free of viruses or harmful components originating from websites you visit; be compatible with every device or OS version; or protect against all security threats, tracking, or privacy risks. You use the App at your own risk, and you are solely responsible for any damage to your device or loss of data.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BIAN OR ITS DEVELOPERS, DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, GOODWILL, USE, OR DATA, ARISING OUT OF OR RELATED TO THE APP, WHETHER OR NOT FORESEEABLE AND REGARDLESS OF THE THEORY OF LIABILITY.

This includes, without limitation, damages arising from: your use of or inability to use the App; maintenance mode, required updates, version disabling, or discontinuation of the App or any feature; unauthorized access to or alteration of your data; loss or corruption of data on your device; third-party websites, content, or services (including those in Section 5); viruses or malware encountered while browsing; reliance on AI-generated content; device malfunction or loss; or any unlawful, fraudulent, or harmful activity conducted through the App by you or others.

IN JURISDICTIONS THAT DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS, THE ABOVE SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED, AND NOTHING IN THIS POLICY EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED (SUCH AS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR FOR FRAUD).

TO THE EXTENT ANY LIABILITY IS NOT LAWFULLY EXCLUDABLE, BIAN'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP (WHICH IS ZERO, AS THE APP IS FREE) OR (B) USD $10.

14. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless BIAN and its developers, officers, directors, employees, agents, licensors, suppliers, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: your use of the App; your violation of this Privacy Policy or any law; your violation of any third-party right (including intellectual property or privacy rights); or any content you access, download, upload, or transmit through the App. This obligation survives termination of your use of the App.

15. Governing Law & Dispute Resolution

This Privacy Policy is governed by the laws of the jurisdiction in which BIAN is established, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your country of residence provide otherwise.

Any dispute shall first be addressed through good-faith negotiation. If unresolved within 30 days, the dispute shall be resolved on an individual basis through the courts or, where applicable and permitted, binding arbitration of the governing jurisdiction.

TO THE EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY CLAIM WILL BE BROUGHT SOLELY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.

15.1 Severability & Entire Agreement

If any provision is held unenforceable, it shall be limited or removed to the minimum extent necessary, and the remainder shall stay in full force. This Privacy Policy, together with any Terms of Service, constitutes the entire agreement between you and BIAN regarding the App and supersedes prior agreements on its subject matter. Our failure to enforce any provision is not a waiver.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Material changes will be reflected by updating the "Last Updated" date above and, where appropriate, through an in-App notice. Your continued use of the App after changes take effect constitutes acceptance of the updated policy. We encourage you to review it periodically.

We will make reasonable efforts to respond within 30 days. We may need to verify your identity or request more detail before responding.

Acknowledgment

BY DOWNLOADING, INSTALLING, OR USING BIANEX BROWSER, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS PRIVACY POLICY AND AGREE TO BE BOUND BY IT, INCLUDING THE DISCLAIMER OF WARRANTIES, LIMITATION OF LIABILITY, AND INDEMNIFICATION PROVISIONS.
