Welcome to Smart Calendar ("the App", "the Software", "our App", "we", "us", or "our"). This Privacy Policy explains how BIAN ("the Company", "the Developer", "we", "us") collects, uses, discloses, and safeguards your information when you use our Smart Calendar application available on Android platforms.

Smart Calendar is an intelligent scheduling application that integrates with your device's calendar system, offers voice-based event creation, and uses on-device AI for smart scheduling predictions. Due to the sensitive nature of calendar data and voice processing, we urge you to read this Privacy Policy carefully.

PLEASE READ THIS PRIVACY POLICY CAREFULLY. By downloading, installing, accessing, or using Smart Calendar, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy and our Terms of Service. If you do not agree with the terms of this Privacy Policy, you must not access or use the App.

Our Core Privacy Principle: Smart Calendar stores your data locally on your device by default. We integrate with your existing calendar accounts (Google Calendar, Samsung Calendar, etc.), and voice features are processed offline on your device. We do NOT independently collect or store your personal data on our servers, and the App contains no third-party analytics or advertising SDKs.

2. Acceptance of Terms

By using Smart Calendar, you expressly acknowledge and agree that:

  • You are at least 13 years of age (or the minimum age required in your jurisdiction)
  • You have the legal capacity to enter into this agreement
  • You consent to the access and modification of your device's calendar data
  • You understand voice features are optional and processed offline on your device
  • You accept full responsibility for all events, appointments, and data managed through the App
  • You will use the App in compliance with all applicable laws
  • You understand that calendar data may reveal personal, professional, and sensitive information
  • You understand that the App is provided "AS IS" without warranties of any kind
  • You waive any claims against BIAN arising from your use of the App

3. Information We Collect

3.1 Information We Do NOT Independently Collect

BIAN does NOT collect, transmit, or store on our servers:

  • Personal identification information (name, email, phone number, address)
  • Your calendar events, appointments, or schedules
  • Voice recordings (speech is processed on your device, offline, and is never recorded or transmitted)
  • Your contacts (only birthday fields are read, on your device — see 3.5)
  • Your photos or media files (read only on your device for "Memories" — see 3.5)
  • Your location (only approximate coordinates are sent to fetch weather if you enable it — see 3.5; no background location)
  • Device identifiers for tracking or advertising purposes
  • Usage analytics transmitted to our servers (the App contains no third-party analytics or crash-reporting SDK)

3.2 Data Accessed Through Android Calendar Provider

Smart Calendar accesses your device's calendar data through Android's Calendar Provider API. This data is managed by your existing calendar accounts (Google, Samsung, Microsoft, etc.):

  • Events: Event titles, descriptions, dates, times, locations
  • Attendees: Participant names and email addresses for shared events
  • Reminders: Notification settings for events
  • Calendars: List of calendar accounts on your device
  • Recurrence: Repeating event patterns
  • Colors/Categories: Event categorization data

3.3 Data Stored Locally by Smart Calendar

The following data is stored locally on YOUR device:

  • App Settings: Your preferences and configurations
  • Widget Data: Cached data for home screen widgets
  • ML Predictions: On-device learning for scheduling suggestions
  • Cache: Temporary data for performance optimization

3.4 Data Collected When Using Cloud Features (Opt-In)

If you enable any optional cloud or account-based feature:

  • Account Information: Email address and authentication tokens
  • Sync Preferences: Which calendars and settings to synchronize
  • Subscription Data: Premium feature entitlements

3.5 Device Data the App Accesses On Your Device

To provide its features, the App accesses the following on your device. This data is processed locally and is not transmitted to BIAN, except where a specific optional feature requires a network request, as noted:

  • Contacts (birthdays): Read-only access to your contacts' birthday fields to show upcoming birthdays. Names and other contact details are not uploaded.
  • Photos / media images: Read-only access to images from a selected date to display the optional "Memories" feature. Images are never uploaded.
  • Microphone / audio: Used only for the optional voice assistant and "Hey Smart" wake word. Audio is processed offline on your device and is never recorded or transmitted (see Section 4).
  • Location (approximate & precise, while using the app): Used only for the optional local weather feature — your approximate coordinates are sent to our weather provider (Open-Meteo) to retrieve a forecast. The App does not request or use background location. Location is never used to track you, build profiles, or for advertising, and is never shared with advertisers.
  • Notifications: Used to deliver the reminders and alarms you create.

Calendar Data Sensitivity: Your calendar data can reveal highly personal information including medical appointments, religious practices, business meetings, personal relationships, travel plans, and daily routines. YOU are responsible for understanding these risks.

4. Voice Data and Speech Recognition

Smart Calendar offers voice-based event creation using speech recognition. This is a critical section regarding your privacy.

4.1 On-Device, Offline Speech Recognition

PRIVACY-FIRST DISCLOSURE: Voice recognition in Smart Calendar — including the optional "Hey Smart" wake word and voice commands — is performed entirely on your device using an offline speech engine. This means:

  • Your voice audio is processed locally on your device
  • Your voice is NOT sent to BIAN, Google, or any other server for recognition
  • Audio is not recorded, saved, or transmitted off your device
  • Only the resulting text (the command you spoke) is used, on-device, to perform the action
  • An internet connection is not required for voice recognition

4.2 How Voice Features Work

  1. You enable the voice assistant and/or the optional "Hey Smart" wake word (both are OFF by default), or tap the microphone icon
  2. Your device's microphone captures audio while listening
  3. An offline, on-device speech engine converts the audio to text locally
  4. The App acts on the recognized text (e.g., creating a reminder) on your device
  5. No voice audio is stored or transmitted

4.3 Voice Model Download

If you enable the "Hey Smart" voice assistant, the App performs a one-time download of the offline speech model from the model provider's host (the Vosk project). This download contains no personal information; it is only the speech-recognition model files needed to process your voice on-device.

4.4 Your Voice Data Choices

  • Voice features are OPTIONAL and OFF by default — you can create events manually
  • The background "Hey Smart" listener only runs if you explicitly enable it
  • You can revoke microphone permission at any time to disable all voice features

5. Calendar Synchronization

Smart Calendar integrates with external calendar services through Android's Calendar Provider.

5.1 Calendar Accounts We Access

Smart Calendar can read and write to calendars from:

  • Google Calendar: If you have Google accounts on your device
  • Samsung Calendar: On Samsung devices
  • Microsoft Exchange/Outlook: If configured on your device
  • Local Device Calendar: Events stored only on your device
  • Other CalDAV Providers: Any calendar synced via Android Calendar Provider

5.2 What We Can Read

  • All events in calendars you grant access to
  • Event details including titles, descriptions, locations, times
  • Attendee information for shared events
  • Reminder and notification settings
  • Recurrence rules for repeating events

5.3 What We Can Write/Modify

  • Create new events in any calendar you authorize
  • Edit existing events (titles, times, details)
  • Delete events you choose to remove
  • Set or modify reminders
  • Add or remove event attendees

5.4 Sync With External Services

When you modify events through Smart Calendar, changes are synced to the respective calendar service (Google Calendar, Outlook, etc.) according to that service's sync schedule. Each service has its own privacy policy governing how it handles your calendar data.

Third-Party Calendar Warning: Smart Calendar accesses calendars through Android's system. Data synced with Google Calendar is subject to Google's Privacy Policy. Data synced with Microsoft is subject to Microsoft's Privacy Policy. BIAN is NOT responsible for how these services handle your data.

6. App Permissions

Smart Calendar requires certain device permissions to function. By granting these permissions, you acknowledge their purpose and accept responsibility for their use:

Permission Control: You can revoke permissions at any time through device settings. Revoking calendar permissions will prevent the App from functioning. Revoking microphone permissions will disable voice features but allow manual event creation.

7. Data Storage and Retention

7.1 Local Storage

Smart Calendar stores the following data locally on your device:

  • App Settings: Preferences, display options, notification settings
  • Widget Cache: Data for home screen widgets
  • ML Model Data: On-device learning for scheduling predictions
  • Temporary Cache: Performance optimization data

7.2 Calendar Data Storage

Calendar events are NOT stored by Smart Calendar directly. They are managed by Android's Calendar Provider and synced with respective calendar services (Google, Microsoft, etc.). Each service has its own retention policies.

7.3 Data Retention

  • App settings persist until you clear app data or uninstall
  • Calendar data is managed by your calendar providers
  • Uninstalling Smart Calendar removes our local data but NOT your calendar events

8. Cloud Services (Optional)

Smart Calendar may offer optional cloud features for enhanced functionality.

8.1 Available Cloud Features

  • Settings Sync: Sync app preferences across devices
  • Cloud Backup: Backup app settings and preferences
  • Premium Features: Cloud-based enhanced functionality

8.2 Cloud Data Handling

If you enable cloud features:

  • Data is encrypted in transit (TLS 1.3) and at rest
  • We use industry-standard cloud infrastructure
  • You can disable cloud features and delete cloud data at any time
  • Account deletion removes all cloud data within 30 days

8.3 Third-Party Cloud Infrastructure

We may use third-party cloud providers (AWS, Google Cloud, etc.) to store cloud data. These providers have their own security measures and privacy policies.

9. Third-Party Services

9.1 Network Services Used by Optional Features

The App works offline for its core functions. It only contacts the following services, and only when you use the related optional feature:

  • Open-Meteo (weather): If you enable weather, your approximate coordinates are sent to retrieve a local forecast. See open-meteo.com/en/terms.
  • Nager.Date (public holidays): If you import holidays, your selected country/region is sent to fetch the holiday list. No personal data is sent.
  • Vosk speech model host: If you enable the "Hey Smart" voice assistant, the App downloads the offline speech model once. No personal data is sent; speech is then processed entirely on your device.
  • Google Play Services / Play Billing: Core Android functionality and, if applicable, any in-app purchase, handled by Google. Google's Privacy Policy (policies.google.com/privacy) applies to those.

Voice recognition is not performed by any cloud service — it runs offline on your device.

9.2 Other Calendar Providers

If you sync with Microsoft, Samsung, or other calendar providers, their respective privacy policies apply to data synced through their services.

9.3 Services We Do NOT Use

  • Facebook SDK or social media tracking
  • Advertising networks or ad SDKs
  • Third-party analytics that identify users
  • Data brokers or data marketplaces

10. Premium Features and Subscriptions

10.1 Payment Processing

  • Payments are processed through Google Play Billing
  • We do NOT directly collect payment card information
  • Google's privacy policy applies to payment processing
  • We receive only payment confirmation, not payment details

10.2 Subscription Data

For premium subscribers, we may store:

  • Subscription status and tier
  • Purchase verification tokens
  • Subscription dates

10.3 Premium Feature Data

Some premium features may require additional data collection or processing. Specific disclosures will be provided when you activate such features.

11. Social Features and Sharing

11.1 Event Sharing

  • You can share events via standard Android sharing
  • Shared events may include dates, times, titles, locations
  • Sharing is initiated by YOU and under YOUR control

11.2 Shared Calendars

If you use shared calendars (through Google Calendar, etc.), other authorized users can see events on those calendars. This is managed by your calendar provider, not by Smart Calendar.

11.3 Social Integrations

Future versions may include social features such as shared schedules or group coordination. These features will be opt-in with specific privacy disclosures at the time of activation.

Sharing Warning: When you share calendar data, you may reveal personal schedules, appointments, and sensitive information. BIAN is NOT responsible for any consequences of data YOU choose to share.

12. Data Security

12.1 Security Measures

  • Local Encryption: Sensitive local data is encrypted
  • Transport Security: TLS 1.3 for all network communications
  • Secure APIs: OAuth 2.0 for calendar provider authentication
  • No Storage of Voice: Voice audio is not stored locally or remotely

12.2 Your Security Responsibilities

  • Secure your Google/Microsoft accounts with strong passwords and 2FA
  • Use device screen lock
  • Keep your device software updated
  • Be cautious about granting calendar access to other apps

Security Disclaimer: BIAN is NOT responsible for security breaches of your calendar provider accounts (Google, Microsoft), compromised devices, or unauthorized access resulting from weak account security or user negligence.

13. Your Rights and Choices

13.1 Access and Control

  • View: View all calendar data through the App
  • Edit: Modify any events accessible to the App
  • Delete: Remove events and clear app data
  • Export: Export calendars via your calendar provider
  • Revoke: Remove app permissions at any time

13.2 Voice Data Rights

  • You can disable voice features by revoking microphone permission
  • The background "Hey Smart" listener is off by default and runs only if you enable it
  • Voice is processed offline on your device; no voice data is recorded, transmitted, or stored to delete

13.3 GDPR Rights (EU/EEA Users)

EU/EEA residents have GDPR rights. For calendar data managed by Google/Microsoft, exercise rights through those providers. For data we process, contact us.

13.4 CCPA Rights (California Users)

  • Right to know what personal information is collected
  • Right to delete personal information
  • We do NOT sell your personal information

14. Children's Privacy

Smart Calendar is not intended for children under 13 years of age.

  • We do NOT knowingly collect data from children under 13
  • If we discover such data, we will delete it promptly
  • Parents should supervise children's use of calendar and voice features

Parental Warning: Voice features send audio to Google. Calendar data may contain sensitive information. Parents should carefully consider whether children should use these features.

15. International Users and Data Transfers

15.1 Global Service

Smart Calendar is available worldwide. By using the App, you consent to data processing in accordance with this Policy regardless of your location.

15.2 Data Transfers

  • Voice data is processed offline on your device and is not transferred anywhere
  • Calendar sync involves data transfer to your calendar provider's servers (governed by their policy)
  • Optional weather and holiday features send minimal data (approximate location / region) to their providers, which may be processed internationally
  • By using these optional features, you consent to such transfers

15.3 Local Law Compliance

It is YOUR responsibility to ensure your use of the App complies with local laws in your jurisdiction.

16. Changes to This Privacy Policy

We may update this Privacy Policy at any time. Changes are effective immediately upon posting.

  • Updates will include a new "Last Updated" date
  • Material changes may be notified through the App
  • Continued use constitutes acceptance of changes
  • Review this Policy periodically

17. Disclaimer of Warranties

BIAN does not warrant that:

  • The App will meet your requirements
  • Calendar sync will be uninterrupted or error-free
  • Voice recognition will be accurate
  • Event reminders will be delivered on time
  • The App will be compatible with all devices or calendar providers
  • AI scheduling predictions will be accurate

18. Limitation of Liability

BIAN is NOT liable for:

  • Missed appointments or events due to reminder failures
  • Calendar sync errors or data loss
  • Voice recognition errors or misinterpretations
  • Inaccurate AI scheduling suggestions
  • Data processed by Google or other third-party services
  • Consequences of shared or exposed calendar data
  • Business losses from scheduling errors
  • Personal or professional consequences from App failures

MAXIMUM LIABILITY: BIAN's total liability shall not exceed the amount paid for premium features in the 12 months preceding the claim.

19. Indemnification

You agree to defend, indemnify, and hold harmless BIAN from any claims arising from:

  • Your use of the App
  • Your violation of this Privacy Policy
  • Your violation of any laws or third-party rights
  • Content of your calendar events
  • Your use of voice features
  • Calendar data you share with others
  • Consequences of missed or incorrect events/reminders

20. Governing Law and Dispute Resolution

20.1 Governing Law

This Privacy Policy is governed by applicable laws without regard to conflict of law provisions.

20.2 Dispute Resolution

Disputes shall first be resolved through good-faith negotiation. If unresolved within 30 days, disputes may proceed to binding arbitration or court as permitted by law.

20.3 Class Action Waiver

CLAIMS WILL BE BROUGHT SOLELY IN YOUR INDIVIDUAL CAPACITY, NOT AS PART OF ANY CLASS OR REPRESENTATIVE PROCEEDING.

20.4 Severability

If any provision is unenforceable, it shall be limited to the minimum extent necessary, with remaining provisions in full force.
