By using My Trackr, you expressly acknowledge and agree that:

  • You understand that the App is provided "AS IS" without warranties of any kind
  • You waive any claims against BIAN, its developers, affiliates, and partners arising from your use of the App
  • You will NOT use the App to track other individuals without their explicit consent
  • You acknowledge that location data could potentially be used in legal proceedings and you accept this risk

IMPORTANT: Your continued use of the App constitutes your ongoing acceptance of this Privacy Policy and any future modifications. If you do not agree to these terms, discontinue use immediately and uninstall the App.

3. Information We Collect

3.1 Information We Do NOT Collect (By Default)

In our default offline mode, we explicitly do NOT collect or transmit:

  • Personal identification information (name, email, phone number, address)
  • Device identifiers (IMEI, Android ID, Advertising ID)
  • Usage analytics or behavioral data to external servers
  • Crash reports transmitted to external servers
  • Financial or payment information (unless using premium features)

The following data is collected and stored ONLY on your device by default. You acknowledge that YOU are solely responsible for this locally stored data:

  • Location History: Historical record of all tracked locations and routes
  • Speed Data: Instantaneous and average speed measurements during activities
  • Distance Data: Calculated distances traveled during tracking sessions
  • Elevation Data: Altitude and elevation change information
  • Activity Labels: Detected or manually assigned activity types (walking, running, cycling, driving)
  • Trip History: Complete records of all tracked trips with timestamps
  • Duration Data: Time spent on each activity or trip
  • Smart Places: Frequently visited locations you designate (home, work, etc.)
  • Offline Maps: Downloaded map tiles for offline use
  • App Settings: Your preferences and configuration choices

3.3 Data Collected When Using Cloud Features (Opt-In)

If you choose to enable cloud features, the following additional data may be collected:

  • Account Information: Email address, username, and authentication tokens
  • Synced Location Data: Your location history synced across devices

Critical Warning - Location Data Sensitivity: Location data is extremely sensitive. It can reveal your home address, workplace, daily routines, places of worship, medical visits, political activities, and personal relationships. YOU are solely responsible for understanding these risks before using this App. BIAN is NOT responsible for any consequences arising from the collection or exposure of your location data, whether through device theft, unauthorized access, legal subpoenas, or any other means.

4. Location Data - Special Provisions

Due to the sensitive nature of location data, this section provides detailed information about how My Trackr handles your geographic information.

4.1 Types of Location Access

  • Foreground Location: Collected when the App is open and actively in use
  • Background Location: Collected when the App is running in the background (if you grant permission)
  • Continuous Tracking: Ongoing location collection during active tracking sessions

4.2 Location Data Accuracy

My Trackr uses high-accuracy GPS location services. Location accuracy typically ranges from 3-10 meters depending on satellite visibility, environmental conditions, and device capabilities. BIAN makes no guarantees about location accuracy and is NOT liable for any inaccuracies.

4.3 Legal Implications of Location Data

LEGAL WARNING: You acknowledge and understand that:

  • Location data stored on your device may be subject to legal discovery, subpoenas, or court orders
  • Speed data could potentially be used as evidence in traffic violation cases
  • Location history could be used in civil or criminal proceedings
  • You are solely responsible for managing and deleting your location data
  • BIAN will comply with valid legal requests but cannot protect data stored on YOUR device
  • We strongly recommend regularly reviewing and deleting location data you no longer need

4.4 Your Control Over Location Data

  • You can pause or stop tracking at any time
  • You can delete individual trips or all location history
  • You can revoke location permissions through device settings
  • You can export your data before deletion for personal backup
  • Uninstalling the App removes all locally stored location data

5. App Permissions

My Trackr requires certain device permissions to function. By granting these permissions, you acknowledge their purpose and accept responsibility for their use:

Background Location Disclosure: This App collects location data even when the app is closed or not in use (during active tracking sessions). This is necessary for accurate route recording during activities. You can stop background collection at any time by ending the tracking session or revoking location permissions.

6. Data Storage and Retention

6.1 Local Storage (Default)

By default, all user data is stored exclusively on your device using encrypted local databases:

  • Database: Room Database with SQLCipher encryption
  • Sensitive Data: Android Keystore for encryption keys
  • Maps: Offline map tiles stored in app-specific storage

6.2 Data Retention

  • Data persists indefinitely until you delete it manually or uninstall the App
  • You can delete individual trips, date ranges, or all history at any time
  • Uninstalling the App removes all associated data from your device
  • We recommend periodic review and deletion of data you no longer need

6.3 Data Export

You can export your tracking data in standard formats (GPX, CSV) for backup or use with other applications. Exported data is YOUR responsibility to secure.

Data Security Responsibility: The security of locally stored data depends on YOUR device security (screen lock, encryption, malware protection). BIAN is NOT responsible for data breaches resulting from compromised devices, lost/stolen devices, malware, or user negligence.

7. Cloud Services (Optional)

My Trackr may offer optional cloud features for data synchronization and backup. These features are strictly OPT-IN and require your explicit consent.

7.1 Cloud Features (When Enabled)

  • Cross-Device Sync: Synchronize tracking data across multiple devices
  • Cloud Backup: Backup your data to secure cloud storage
  • Account Management: Manage your subscription and preferences

7.2 Data Transmission

When cloud features are enabled:

8. Third-Party Services

8.1 Map Providers

My Trackr uses third-party map services to display maps and routes. When you use map features:

  • Map tile requests are sent to map providers (OpenStreetMap, Google Maps, or others)
  • These requests may include your approximate viewing area

  • Offline maps, once downloaded, do not require internet connectivity

  • We do NOT directly collect or store payment card information
  • Google's privacy policy applies to payment processing
  • We receive only confirmation of payment status, not payment details

Sharing Warning: When you share location data (routes, trips, places), you may reveal sensitive information about your movements, routines, and locations. BIAN is NOT responsible for any consequences of data YOU choose to share.

We implement reasonable security measures to protect your data. However, no method of storage or transmission is 100% secure.

BIAN does not warrant that:

  • The App will meet your requirements or expectations
  • The App will be uninterrupted, timely, secure, or error-free
  • Location data will be accurate, complete, or reliable
  • Speed, distance, or activity measurements will be precise
  • The App will be compatible with all devices
  • GPS signals will be available in all locations
  • Any errors in the App will be corrected

You acknowledge that GPS accuracy varies based on environmental conditions, device capabilities, and satellite availability. BIAN is NOT responsible for any decisions or actions you take based on data from this App.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BIAN, ITS DEVELOPERS, DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

BIAN shall not be liable for any damages arising from:

  • Your use or inability to use the App
  • Inaccurate location, speed, distance, or activity data
  • Decisions made based on App data (navigation, safety, legal matters)
  • Loss, theft, or unauthorized access to your location data
  • Legal proceedings involving your location or speed data
  • Device battery drain, damage, or malfunction
  • Traffic violations or accidents related to App use
  • Privacy breaches resulting from device compromise
  • Third-party access to exported or shared data
  • Cloud service outages, data loss, or breaches
  • Any illegal activities conducted using the App

IN NO EVENT SHALL BIAN'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE APP OR PREMIUM FEATURES IN THE 12 MONTHS PRECEDING THE CLAIM.

18. Indemnification

You agree to defend, indemnify, and hold harmless BIAN, its developers, officers, directors, employees, agents, and partners from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

  • Your use of and access to the App
  • Your violation of this Privacy Policy
  • Your violation of any applicable law or regulation
  • Your violation of any third-party rights
  • Any claim that your location data was improperly collected, used, or disclosed
  • Any use of the App to track other individuals
  • Any content you share or export from the App
  • Legal proceedings involving your location or activity data
  • Any traffic violations, accidents, or injuries related to App use

This indemnification obligation survives termination of this Policy and your use of the App.

19. Governing Law and Dispute Resolution

19.1 Governing Law

This Privacy Policy shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. You agree to submit to the jurisdiction of courts as determined by applicable law.

YOU FURTHER ACKNOWLEDGE THAT THIS PRIVACY POLICY, TOGETHER WITH THE LIMITATION OF LIABILITY, DISCLAIMER OF WARRANTIES, AND INDEMNIFICATION PROVISIONS, REPRESENT THE COMPLETE AGREEMENT BETWEEN YOU AND BIAN.
